Louis Busico Secures Dismissal of Assault and Robbery Charges

Assault, Robbery Charges Dropped

A district judge on Tuesday dismissed criminal charges against a robbery and assault suspect whose alleged actions in March resulted in a SWAT team locking down the Yardley Commons for several hours.


The judge, Michael J. Burns, declined to comment on why he dismissed the charges. But Louis Busico, the attorney for defendant Scott Marks, said the prosecution’s only witness couldn’t prove a crime occurred.


On March 29, that witness called police to say he was assaulted, robbed, and threatened by Marks, 44, of 905 Yardley Commons. The two men reportedly had been drinking together. The man called police, who eventually called in the SWAT team after Marks allegedly cursed at officers and barricaded himself in his home.


But when the alleged victim took the stand Tuesday, his testimony wasn’t sufficient to send the charges to trial, Busico said.


“His testimony did not make out the elements of any crime,” Busico said. “It was very hard to ascertain what he was saying. His testimony was all over the place.”


Busico added: “There were two guys who had known each other for a while and were both acting like knuckleheads.”


After attempting to talk to Marks, police left the house to get an arrest warrant. Marks then called 911 to say he had cut off his thumb and wanted to know how to “put it back on,” according to court records.


Sometime later, police said they saw Marks allegedly bleeding with a pit bull dog nearby and speaking into a hairbrush as though it were a phone.
